FOSTA and SESTA is actually a very different thing that would target primarily live porno and contracting oriented sites, not hentai. Rather than dealing with political correctness of access to smut, it targets actual criminal involvement on a topic that is already illegal to participate in (save for some exceptions in the US... Vegas baby! One part of it at least). If you run a site that is knowingly involved in sex trafficking, then FOSTA and SESTA gives the grounds for a legal response against you.

Lots of media outlets lost their head over it and made some pretty ridiculous claims, very similar to the Net Neutrality fiasco. Many claim it affects freedom of speech, but it doesn't since since FOSTA and SESTA does not affect you unless someone can bring proof that you deliberately were involved in it. Ironically many claim that it undermines Section 230 Safe Harbor, when Section 230 actually does not protect someone from participation in criminal acts over the internet. Section 230 protects you from liability such as being sued for one of your members commiting "hate speech" (which ironically is that crime is more of a threat to free speech than anything else). Section 230 protects you from civil law, it never did, nor does it now protect you from criminal law. After-all, that is why the FBI can go after ID thieves and such.

The most common argument I have heard is that F&S makes sex workers scared to do their illegal business on the internet and will move to the streets. It scares the sex industry... which is the whole point. Not only is it easier for law enforcement to stop crimes that they can witness, crimes are illegal regardless if you do it in the public or the internet. People wonder why it passed so easily with such high bipartisan support, because it is redundant legislation, clarifying the previous legal misconceptions many had previously thinking what happens on the net stays on the net. There are some trying to say this is unconstitutional, but that is as silly as saying that the internet is a sanctuary for crime. Crime is crime no matter where it is committed. The only reasons Section 230 exists is to protect people on the internet from civil lawsuit double jeopardy, which actually is unconstitutional when you think about it (excuse of money vs crime, but that really is irrelevant to the intent of the fifth amendment).

Worst part of all of this is that many people who supposedly have been rallying for elimination of sex trafficking have flipped and now are trying to imply it is a legitimate line of business. First the said it was slavery of women, now they are saying it was empowering. Either way, it is illegal.

TLDR: It doesn't affect 2D waifus, it affects 3D waifus (and only when there is evidence that one is participating in the proliferation of the crime).

We are already seeing social media platforms starting to make moves. I hear Twitter has started clamping down more on hentai content and I recall Tumblr was doing the same thing a little back also. I had been wondering why quite a few Japanese artists had been wiping image posts from their Twitter.

I especially think that kind of moderation is stupid since kids shouldn't be using social media anyways. When I have a kid I'm really not planning on letting them use much of the internet, TV, or have a smartphone unsupervised until they hit around 14-15. There are plenty of other productive things they can do until that point.

I recall this was something that got thrown out serveral years ago I guess they're trying again.

I fear it may be more likely to get approved this time with all the snowflakes running around these days demanding everything they don't like to be banned.

We are already seeing social media platforms starting to make moves. I hear Twitter has started clamping down more on hentai content and I recall Tumblr was doing the same thing a little back also.
